1. Acceptance of Terms

By accessing and using Casa PH ("the Platform"), you accept and agree to be bound by these Terms of Service, our Privacy Policy, and all applicable Philippine laws, including Republic Act No. 10173 (Data Privacy Act of 2012). If you do not agree to these terms, please do not use our services.

2. Description of Service

Casa PH is an online real estate platform that connects PRC-licensed real estate brokers and PRC-accredited real estate salespersons with potential buyers and renters in the Philippines. We provide listing services, search functionality, and communication tools to facilitate property transactions.

3. User Accounts

To access certain features of the Platform, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Professional Requirements

Real estate professionals using our Platform must:

• Hold a valid PRC real estate broker license or valid PRC real estate salesperson accreditation
• If acting as a real estate salesperson, operate under a supervising licensed broker as required by RA 9646
• Provide accurate license or accreditation information for verification
• Comply with all applicable Philippine real estate laws and regulations
• Ensure all property listings are accurate and up-to-date
• Respond professionally to inquiries from potential clients

5. Property Listings

When posting property listings, professionals agree that:

• All listing information must be accurate, complete, and not misleading
• Photos must accurately represent the property
• Pricing information must be current and transparent
• Properties must be legally available for sale or rent
• Listings must not infringe on any third-party rights

6. Prohibited Activities

Users may not:

• Post false, misleading, or fraudulent information
• Impersonate others or misrepresent credentials
• Use the Platform for illegal purposes
• Harass, abuse, or harm other users
• Attempt to circumvent security measures
• Scrape or extract data without authorization
• Interfere with the Platform's operation

7. Data Privacy and RA 10173 Compliance

Casa PH is committed to protecting your personal data in accordance with Republic Act No. 10173 (Data Privacy Act of 2012) and its Implementing Rules and Regulations. By using our Platform, you acknowledge and agree to the following:

• Personal data collection: We collect and process personal information as described in our Privacy Policy, which forms an integral part of these Terms.
• Lawful processing: Depending on the feature you use, we process personal data based on consent, contractual necessity, legitimate interests, legal obligation, or other lawful bases described in our Privacy Policy.
• Data subject rights: You may exercise your rights under RA 10173 — including the rights to access, correct, erase, and port your data — through our Data Privacy Request page.
• Data sharing: We may share your personal data with third-party service providers as described in our Privacy Policy, subject to appropriate safeguards and contractual obligations.

• Breach notification: In the event of a data breach that poses a risk of harm, we will notify the National Privacy Commission and affected individuals within seventy-two (72) hours, as required by law.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Casa PH or its content suppliers and is protected by Philippine and international intellectual property laws. Users retain ownership of content they submit but grant Casa PH a license to use, display, and distribute such content on the Platform.

9. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. Casa PH does not guarantee the accuracy of listings, the qualifications of professionals beyond initial verification, or the outcome of any property transactions. Users should conduct their own due diligence before entering into any real estate transactions.

While Casa PH may review credentials, listings, reports, and other trust signals, these measures are intended only to help reduce risk and do not eliminate the possibility of fraud, scams, misrepresentation, failed negotiations, payment issues, title or ownership disputes, or other unfavorable transaction outcomes. Users remain responsible for independently verifying property details, legal documents, authority to sell or lease, and the identity and legitimacy of the other party before proceeding with any transaction.

10. Limitation of Liability

To the maximum extent permitted by law, Casa PH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Casa PH is not a party to any real estate transactions between users and is not responsible for disputes between professionals and clients.

11. Indemnification

You agree to indemnify and hold harmless Casa PH, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

Casa PH reserves the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. Account deactivation or suspension does not automatically mean all personal data is immediately deleted; retention, deletion, and erasure requests are handled in accordance with our Privacy Policy, security needs, and applicable law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including but not limited to RA 10173 (Data Privacy Act of 2012) and its IRR. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Philippines.

14. Changes to Terms

Casa PH reserves the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
